Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Jatgam LLC, a Massachusetts limited liability company ("Jatgam," "we," "us," or "our"), governing your use of Orblet and our related websites, web app, and mobile apps (collectively, the "Service").
Please read these Terms carefully. Section 13 contains a binding arbitration agreement and a class-action waiver that affect how disputes are resolved.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Subscription & Billing Terms, which are incorporated by reference.
1. Eligibility
You must be at least 18 years old to create an account and to form or join a family. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms. You are responsible for any information you enter about other people (including children and other family members) and represent that you have the authority to provide it.
2. Your account
- You must provide accurate account information and keep it current.
- You are responsible for safeguarding your password and for all activity under your account.
- Notify us promptly at support@orblet.app of any unauthorized use or security breach.
- You may not share your account credentials or let others access the Service through your account except as the Service intends (for example, by inviting members to your family).
3. Families, roles, and members
The Service organizes content into families. A family includes members with roles (such as administrators and members) and may include "virtual members," including children, whose information is managed by the family's adult members.
- Content created within a family is visible to the members of that family.
- Administrators can manage members and may have the ability to remove members or delete family content.
- You are responsible for what you and your family members do within your family workspace, and for resolving any disputes among members. We are not responsible for the conduct of family members or for content they create.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- enter information about another person without the authority to do so;
- upload content that is illegal, infringing, harmful, or that you do not have the right to upload;
- attempt to gain unauthorized access to the Service, other users' data, or our systems;
- interfere with, disrupt, overload, or probe the Service or its infrastructure;
- reverse engineer, decompile, or attempt to extract source code except to the extent this restriction is prohibited by law;
- use the Service to build a competing product, or scrape or harvest data from it;
- circumvent subscription gating or any access controls.
We may suspend or terminate accounts that violate these Terms.
5. Your content
- You own your content. You retain all rights to the content you and your family create in the Service ("Your Content").
- License to operate the Service. You grant Jatgam a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content solely as necessary to operate, secure, and provide the Service to you and your family. This license ends when Your Content is deleted, except for residual copies in backups or logs that are purged in the ordinary course.
- Your responsibility. You are solely responsible for Your Content and for ensuring you have the rights to it.
6. Our intellectual property
The Service, including the Orblet application, the Orblet and Jatgam names and logos, and all software, designs, and content we provide (excluding Your Content), is owned by Jatgam LLC and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, household use, subject to these Terms. No other rights are granted.
7. Subscriptions and advertising
Some features require a paid subscription. Free trials, billing, auto-renewal, cancellation, and refunds are described in the Subscription & Billing Terms. Purchases made through the Apple App Store or Google Play are also subject to those stores' terms.
The free tier of the Service is supported by advertising shown by third-party advertising partners; an active subscription removes ads. How advertising and analytics information is handled is described in the Privacy Policy.
8. Third-party services
The Service relies on and may integrate third-party services (for example, app stores, cloud infrastructure, email delivery, push-notification services, payment providers, and calendar subscription via ICS). We are not responsible for third-party services, and your use of them may be subject to their own terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Reminders and notifications are provided on a best-effort basis and may be delayed, undelivered, or inaccurate due to factors outside our control (device settings, network conditions, third-party push services, and platform limits). Do not rely on the Service as the sole means of managing safety-critical matters, including childcare coverage, medical needs, or time-sensitive obligations. You are responsible for independently verifying anything important.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of data loss.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Jatgam will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or related to the Service, even if advised of the possibility of such damages.
- Jatgam's total cumulative liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid Jatgam for the Service in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars ($50).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Jatgam LLC and its officers, agents, and representatives from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Service, your violation of these Terms, your content, or your violation of any law or the rights of a third party (including any person whose information you entered).
12. Termination
- By you: you may stop using the Service and delete your account at any time.
- By us: we may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. We will make reasonable efforts to give notice where practical.
- Effect: upon termination, your right to use the Service ends. Sections that by their nature should survive (including Sections 5–6, 9–11, 13, and 14) survive termination. See the Privacy Policy and Subscription & Billing Terms for data deletion and subscription effects.
13. Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully — it affects your legal rights.
13.1 Informal resolution first. Before starting an arbitration, you agree to contact us at legal@orblet.app and try to resolve the dispute informally for at least 30 days.
13.2 Binding arbitration. If we cannot resolve a dispute informally, you and Jatgam agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration, rather than in court, except as provided below. Arbitration will be administered by a recognized arbitration provider under its consumer rules, and judgment on the award may be entered in any court of competent jurisdiction.
13.3 Class-action and jury-trial waiver. You and Jatgam agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims. You and Jatgam waive any right to a jury trial.
13.4 Small-claims exception. Either party may bring an individual claim in small-claims court if it qualifies and remains in that court.
13.5 Right to opt out. You may opt out of this arbitration agreement by emailing legal@orblet.app within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. If you opt out, Section 13.6 governs disputes.
13.6 Forum for non-arbitrated disputes. For any dispute not subject to arbitration, you and Jatgam consent to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Massachusetts.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles, and, with respect to arbitration, by the Federal Arbitration Act.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email and update the "Last updated" date. Continued use of the Service after an update means you accept the revised Terms. If you do not agree, stop using the Service.
16. Apple and Google app-store terms
If you obtained the app from the Apple App Store or Google Play, additional store-specific terms apply. For iOS, you acknowledge that these Terms are between you and Jatgam, not Apple; that Apple is not responsible for the app or its content; and that Apple is a third-party beneficiary entitled to enforce these Terms against you. Similar provisions apply to Google where required.
17. Miscellaneous
- Entire agreement: these Terms, the Privacy Policy, and the Subscription & Billing Terms are the entire agreement between you and Jatgam regarding the Service.
- Severability: if any provision is unenforceable, the rest remains in effect, except that if the class-action waiver in Section 13.3 is found unenforceable, the arbitration agreement in Section 13 will be void.
- No waiver: our failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
